AN ORDINANCE ENLARGING THE CORPORATE BOUNDARIES OF THE TOWN OF TISHOMINGO, MISSISSIPPI, DEFINING WITH CERTAINTY BOTH THE TERRITORY TO BE ANNEXED AND THE ENTIRE BOUNDARY OF THE TOWN OF TISHOMINGO, MISSISSIPPI, AS CHANGED, AND DESCRIBING THE MANNER AND EXTENT AND TIME FRAME FOR PROPOSED IMPROVEMENTS AND SERVICES TO BE MADE AND RENDERED IN SUCH ANNEXED TERRITORY.

WHEREAS, the unincorporated parcels of land hereby annexed adjoin the Town of Tishomingo, Mississippi, and both the new Territories included and the entire boundary as changed are defined herein; and,

WHEREAS, reasonable public and municipal improvements and services will be rendered within a reasonable time within the territories hereby annexed; and,

WHEREAS, reasonable public and municipal improvements and services will be rendered within a reasonable time within the territories hereby annexed; and,

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF ALDERMAN OF THE TOWN OF TISHOMINGO, MISSISSIPPI, as follows, to wit:

SECTION 1:

BE IT ORDAINED by the Mayor and the Board of Aldermen of Tishomingo, Mississippi, that the corporate boundaries of the Town of Tishomingo, Tishomingo County, Mississippi, be and they are hereby extended and enlarged to include the following described territories in Tishomingo County, Mississippi, not heretofore within the corporate boundaries of said Town, to wit:

A Part of the Northeast Quarter of Section 15, Township 5 South, Range 10 East, Chickasaw Meridian, Tishomingo County, Mississippi, being more particularly described as follows: Commencing at a driven axle found at the Northwest

Quarter of the said Northeast Quarter; Thence with the State Plane Grid run with the West line of the said Northeast Quarter South 00°50'56" West for a distance of 957.98 feet to the Northerly Right-of-Way of State Highway #30; Thence leaving the said West line, run with the said Right-of-Way South 71°37'31" East for a distance of 117.74 feet; Thence run South 18°22'29" West for a distance of 65.00 feet; Thence run South 71°37'31" East for a distance of 288.44 feet to a capped iron pin set at the Point of Beginning; Thence leaving the said Right-of-Way, run North 18°22'29" East for a distance of 630.00 feet to a capped iron pin set; Thence run South 71°37'31" East for a distance of 502.94 feet to a capped iron pin set in the Westerly Right-of-Way of State Highway #25; Thence run with the said Westerly Right-of-Way South 10°41'50" West for a distance of 158.32 feet to a one inch bolt found; Thence leaving the said Right-of-Way, run North 75°17'30" West for a distance of 161.32 feet to a capped iron pin set; Thence run South 10°39'48" West through a capped iron pin set at 146.48 feet for a total distance of 356.52 feet to a cotton picker spindle set in the aforesaid Northerly Right-of-Way of State Highway #30; Thence run with the said Right-of-Way South 60°36'39" West for a distance of 147.86 feet to a cotton picker spindle set; Thence run North 71°37'31" West for a distance of 311.56 feet to the Point of Beginning, containing 6.00 Acres, more or less.

SECTION 2:

BE IT FURTHER ORDAINED by said Mayor and Board of Aldermen that the entire corporate boundaries of the Town after its extension to include the above described territory shall be as follows, to wit:

The Northeast Quarter, the East Half of the Northwest Quarter, The Northeast Quarter of the Southwest Quarter, and Part of the of the Southeast Quarter of Section 22; A Part of the Southeast Quarter, The Southeast Quarter of the Southwest Quarter, and Part of the Northeast Quarter of Section 15; A Part of the Southeast Quarter of Section 10; Part of the Northeast Quarter of the Northeast Quarter of Section 27; All in Township 5 South, Range 10 East, Chickasaw Meridian, Tishomingo County, Mississippi, being more particularly described as follows: Beginning at an iron bar located at the locally accepted Northwest Corner of the Southeast Quarter of said Section 10; Thence with the State Plane Grid run with the North Line of the said Southeast Quarter North 88 degrees 42 minutes 56 seconds East for a distance of 1060.08 feet to a one-half inch iron pin; Thence leaving the said North Line, run South 22 degrees 21 minutes 42 seconds East for a distance of 612.09 feet to a ditch; Thence run with the said ditch South 74 degrees 31 minutes 29 seconds East for a distance of 117.26 feet to a one-half inch iron pipe; Thence leaving the said ditch, run South 89 degrees 14 minutes 47 seconds East for a distance of 229.12 feet to a three-eighths inch iron pin in the Westerly Right-of-way of State Highway #25; Thence run South 79 degrees 19 minutes 28 seconds East for a distance of 150.01 feet to the Easterly Right-of-way of the said Highway, being 75 feet Southeasterly of, as measured normal to, the Centerline of the said Highway; Thence run parallel to the said Highway Centerline South 10 degrees 40 minutes 32 seconds West for a distance of 5196.54 feet; Thence run along a curve concave to the left having a radius of 8519.37 feet, and a chord bearing of South 10 degrees 36 minutes 56 seconds West, (chord length 18.81 feet) for an arc distance of 18.81 feet to a capped iron pin; Thence leaving the said parallel line, run South 89 degrees 39 minutes 27 seconds East for a distance of 905.24 feet to a capped iron pin; Thence run North 00 degrees 37 minutes 14 seconds East for a distance of 449.32 feet to a three-eighths inch iron pin in the North Line of the Southeast Quarter of said Section 15; Thence run with the said North Line North 89 degrees 43 minutes 19 seconds East for a distance of 956.78 feet to a crosstie fence corner at the Northeast Corner of the said Southeast Quarter; Thence run with the East Line of the said Southeast Quarter South 01 degrees 28 minutes 32 seconds East for a distance of 1320.50 feet to an axle at the Southeast Corner of the North Half of the said Southeast Quarter; Thence run South 03 degrees 52 minutes 26 seconds East for a distance of 1318.24 feet to a capped iron pin at the Northeast Corner of the Northeast Quarter of said Section 22; Thence run with the East Line of the said Northeast Quarter South 01 degrees 05 minutes 09 seconds East for a distance of 1774.06 feet; Thence leaving the said East Line, run North 89 degrees 24 minutes 39 seconds East for a distance of 2617.16 feet to a one and one-quarter inch iron pin in a fence and in the East Line of the Northwest Quarter of said Section 23; Thence run with the said East Line, and generally with a fence and remnants of a fence, South 02 degrees 12 minutes 21 seconds East for a distance of 857.58 feet to a five-eighths inch iron pipe on the North side of Highland Road at a former fence corner, being 12 feet Northerly of, as measured normal to, the Centerline of said Highland Road, and the South Line of the said Northwest Quarter; Thence run Westerly and parallel to the said Centerline, but generally the following courses and distances: South 89 degrees 46 minutes 30 seconds West for a distance of 2182.77 feet; Thence run North 78 degrees 57 minutes 14 seconds West for a distance of 107.06 feet; Thence leaving the said parallel line, run South 01 degrees 18 minutes 50 seconds East, passing a capped iron pin at 59.02 feet, for a total distance of 1386.76 feet to the South Line of the North Half of the Southwest Quarter of said Section 23; Thence run with the said South Line South 89 degrees 30 minutes 51 seconds West for a distance of 346.12 feet to a one-half inch iron pin at the Northeast Corner of the South Half of the Southeast Quarter of said Section 22; Thence run with the North Line of the said South Half North 89 degrees 53 minutes 10 seconds West, passing a capped iron pin at 825.15 feet, for a total distance of 1114.35 feet to the Easterly Right-of-way of the Old Highway #25, being 15 feet Northeasterly of, as measured normal to, the Centerline of the said Highway; Thence run Southerly and parallel to the said Old Highway Centerline, but generally the following courses and distances: South 26 degrees 49 minutes 00 seconds East for a distance of 327.38 feet; Thence run along a curve concave to the right having a radius of 1912.25 feet, and a chord bearing of South 19 degrees 16 minutes 58 seconds East, (chord length 501.43 feet) for an arc distance of 502.88 feet; Thence run South 11 degrees 44 minutes 57 seconds East for a distance of 1041.43 feet to the Easterly Right-of-way of State Highway #25, being 75 feet Northeasterly of, as measured normal to, the Centerline of State Highway #25; Thence leaving the said parallel line, run with the said State Highway #25 Easterly Right-of-way South 28 degrees 23 minutes 48 seconds East for a distance of 287.72 feet; Thence leaving the said Easterly Right-of-way, run South 88 degrees 57 minutes 36 seconds West, passing a capped iron pin at 168.89 feet, for a total distance of 395.43 feet to a point being 275 feet Southwesterly of, as measured normal to, the aforesaid State Highway #25 Centerline; Thence run parallel to the said Centerline North 28 degrees 17 minutes 41 seconds West for a distance of 2324.77 feet to the North Line of the aforesaid South Half; Thence leaving the said parallel line, run with the said North Line North 89 degrees 53 minutes 10 seconds West for a distance of 707.45 feet to a capped iron pin at the Southeast Corner of the Northeast Quarter of the Southwest Quarter of said Section 22; Thence run with the South Line of the Northeast Quarter of the said Southwest Quarter South 89 degrees 25 minutes 36 seconds West for a distance of 1338.98 feet to a capped iron pin at the Southwest Corner of the Northeast Quarter of the said Southwest Quarter; Thence run with the West Line of the Northeast Quarter of the said Southwest Quarter North 01 degrees 00 minutes 44 seconds West for a distance of 1360.98 feet to a steel tee post at the Southwest Corner of the Southeast Quarter of the Northwest Quarter of said Section 22; Thence run with the West Line of the Southeast Quarter of the Northwest Quarter North 03 degrees 07 minutes 18 seconds West for a distance of 1377.76 feet to a steel tee post at the locally accepted Southwest Corner of the Northeast Quarter of the Northwest Quarter of said Section 22; Thence run North 00 degrees 21 minutes 45 seconds West for a distance of 1270.49 feet to a steel tee post at the Southwest Corner of the Southeast Quarter of the Southwest Quarter of said Section 15; Thence run with the West Line of the Southeast Quarter of the said Southwest Quarter North 01 degrees 13 minutes 31 seconds West for a distance of 1322.84 feet to the Northwest Corner of the Southeast Quarter of the said Southwest Quarter; Thence run with the North Line of the Southeast Quarter of the said Southwest Quarter South 89 degrees 37 minutes 24 seconds East for a distance of 1319.72 feet to a three-quarter inch pipe at the Southwest Corner of the Northwest Quarter of the Southeast Quarter of said Section 22; Thence run with the West Line of the said Southeast Quarter North 01 degrees 05 minutes 41 seconds West for a distance of 751.00 feet to a capped iron pin; Thence leaving the said West Line, run North 89 degrees 32 minutes 18 seconds East for a distance of 292.84 feet; Thence run North 89 degrees 32 minutes 18 seconds East for a distance of 129.00 feet; Thence run along a curve concave to the right having a radius of 8829.37 feet, and a chord bearing of North 10°05'45" East, (chord length 179.66 feet) for an arc distance of 179.66 feet; Thence run North 10°39'01" East for a distance of 1894.06 feet to a cotton picker spindle; Thence run South 60°36'10" West for a distance of 147.86 feet to a cotton picker spindle; Thence run North 71°37'31" West for a distance of 311.56 feet to a capped iron pin; Thence run North 18°22'29" East for a distance of 630.00 feet to a capped iron pin; Thence run South 71°37'31" East for a distance of 341.42 feet; Thence run North 10°40'32" East for a distance of 672.12 feet; Thence run South 89°49'39" West, through a three-quarter inch iron pin at 45.55 feet, for a total distance of 997.91 feet to a one and one-quarter inch hexagonal iron pin found at the Southwest Corner of the said South Half; Thence run with the West Line of the Southeast Quarter of said Section 10 North 00°45'10" West for a distance of 1468.37 feet to a three-quarter inch iron pipe at the locally accepted Northwest Corner of the said South Half; Thence run with the West Line of the Southeast Quarter of said Section 10 North 01°40'06" West for a distance of 591.43 feet to an axle found at the locally accepted Southwest Corner of the North Half of the North Half of the said Southeast Quarter; Thence continuing with the said West Line, run North 05°25'40" West for a distance of 561.98 feet to the Point of Beginning, containing 755.82 Acres, more or less.

SECTION 3:

BE IT FURTHER ORDAINED that where necessary and economically feasible, the improvements proposed to be made by the Town of Tishomingo in the territories described in Section 1 hereof will be made as soon as reasonably practical, but in no event to exceed a period of five (5) years; said improvements are described generally as follows, to wit:

PROPOSED IMPROVEMENT MANNER AND EXTENT OF IMPROVEMENT

use and fire protection fire protection to all developed areas not having water lines of sufficient size sanitary sewer system construct sanitary sewer lines to provide sanitary sewer facilities to all developed areas that do not have sanitary sewer facilities connected to the Town sewer system

SECTION 4:

BE IT FURTHER ORDAINED that the municipal or public services to which the Town of Tishomingo will render in the territory described in Section 1hereof immediately upon the effective date of this ordinance are described as follows:

1. Provide regular police patrol and protection;

2. Provide drainage maintenance;

3. Provide street lighting where necessary;

4. Provide maintenance of existing and in use streets;

5. Provide maintenance of existing and in use sewer line already connected to the Town existing system;

6. Provide the use and benefit of all other municipal services and facilities.

SECTION 5:

BE IT FURTHER ORDAINED that this Ordinance shall be published and take effect as provided in Title 21, Chapter 1 (Sections 21-1-27, et seq.) Mississippi Code of 1972, as amended and related statutes, and that the municipal authorities of the Town of Tishomingo shall proceed to do and perform all things in this behalf in the manner, form and time as is required by the laws of the State of Mississippi in such eases made and provided and as aforesaid. The above and foregoing Ordinance was introduced in writing, read and considered section by section, and voted upon as follows:
