SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, on the 13th day of September, 2023, Rebecca Kay Williams and Tyler Vandiver executed a Deed of Trust to Fred C. Permenter, Jr., Trustee, for the benefit of Northeast Mississippi Planning & Development District, which Deed of Trust is of record at Instrument Number 2023002847 in the office of the Chancery Clerk of Tishomingo County, Mississippi; and

WHEREAS, on the 13th day of September, 2023, Rebecca Kay Williams and Tyler Vandiver executed a Deed of Trust to Fred C. Permenter, Jr., Trustee, for the benefit of Northeast Mississippi Planning & Development District, which Deed of Trust is of record at Instrument Number 2023002848 in the office of the Chancery Clerk of Tishomingo County, Mississippi; and

WHEREAS, on the 13th day of September, 2023, Rebecca Kay Williams and Tyler Vandiver executed a Deed of Trust to Fred C. Permenter, Jr., Trustee, for the benefit of Northeast Mississippi Planning & Development District, which Deed of Trust is of record at Instrument Number 2023002849 in the office of the Chancery Clerk of Tishomingo County, Mississippi; and

WHEREAS, on the 1st day of July, 2024, Northeast Mississippi Planning & Development District, did substitute and appoint Nicholas B. Phillips as the Substitute Trustee at Instrument Number 2024001911 in the office of the Chancery Clerk of Tishomingo County, Mississippi for Instrument Numbers 2023002847, 2023002848, and 2023002849, and

WHEREAS, default having been made in the terms and conditions of said Deeds of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deeds of Trust and the legal holder, the Northeast Mississippi Planning & Development District, having requested the undersigned Trustee to execute this trust and sell said land and property in accordance with the terms of said Deeds of Trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Trustee’s fees and expenses of sale.

NOW, THEREFORE, I, Nicholas B. Phillips, Substitute Trustee in said Deeds of Trust, will on the 6th day of September, 2024, offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 o’clock a.m. and 4:00 o’clock p.m.) at the East Main door of the County Courthouse in the County of Tishomingo, Iuka, Mississippi, to the highest and best bidder for cash, the following described property, lying and being situated in Tishomingo County, Mississippi, to-wit:

The undersigned will convey only such title as is vested in him as Substitute Trustee.

COMMENCING at a 1 inch Pipe (found), being the Northeast corner of the Southeast Quarter of Section 11, Township 3 South, Range 9 East, Tishomingo, Mississippi, Chickasaw Meridian; thence run North 89 degrees 10 minutes 56 seconds West for a distance of 2,194.41 feet, to a point; thence run South for a distance of 3.93 feet, to an Iron Pin (found) on the South line of Gross Avenue and marking the Northeast Corner of the Paula Gaines property as described in Deed Reference 2017001379 recorded in the Office of the Chancery Clerk, Tishomingo County, Mississippi, and the POINT OF BEGINNING; thence run along said Gaines Deed line, South 04 degrees 00 minutes 00 seconds West for a distance of 249.42 feet, to an Iron Pin Set; thence run East for a distance of 247.41 feet, to an iron Pin Set on the West right-of-way line of a proposed road; thence run along said West right-of-way North 00 degrees 59 minutes 41 seconds East for a distance of 174.99 feet, to a Set Iron Pin at a Point of Curvature of a simple Circular Curve with the following characteristics: Delta Angle: 89 degrees 22 minutes 58 seconds (LT); Radius: 68.00 feet; Tangent Length: 67.27 feet; Thence run along said curve in a Northwesterly direction for a distance of 106.08 feet to a Set Iron Pin, having a Chord Bearing of North 43 degrees 41 minutes 48 seconds West and a Chord Distance of 95.65 feet to a point on the South line of Gross Avenue; thence run North 88 degrees 23 minutes 16 seconds West along the South line of Gross Avenue for a distance of 167.04 feet, more or less, to the POINT OF BEGINNING.
